In a California private sale, the seller is generally responsible for giving the buyer a valid smog certificate. As a buyer, the safest move is to make sure that certificate exists and is current before you pay.
Here is how the change-of-ownership smog works, the common exemptions, and what to do if a car you have just bought turns out to have a problem.
Who is responsible
Under California rules, the seller must provide a valid smog certification at the time of sale for vehicles that require one. A buyer agreeing to take care of the smog themselves does not change what the law expects of the seller, so treat any 'you can smog it yourself' offer with caution.
How long the certificate lasts
A smog certificate is valid for 90 days from the date of the inspection. If the sale drags on past that, the seller may need a new one. Check the date on the certificate when you look at the paperwork.
Common exemptions
Some transfers do not need a smog certificate. They include vehicles that are four or fewer model years old, and transfers between certain family members, such as a spouse, domestic partner, sibling, child, parent, grandparent or grandchild. Electric vehicles and gasoline vehicles from model year 1975 or older are also exempt.

If the car fails after you buy it
Sometimes a car passes for the sale and fails at its next renewal, or the paperwork was not quite what it seemed. Either way you need a diagnosis.
